Tenth Amendment Center: To the Governor: Utah Passes Bill to Expand Raw Milk Sales, Reject Federal Prohibition Scheme

...from Tenth Amendment Center SALT LAKE CITY , Utah (Feb. 28, 2020) – Today, the Utah Senate gave final approval to a bill that would further expand raw milk sales in the state. Final passage of this bill would take another important step toward rejecting a federal prohibition scheme in effect. Rep. Kim Coleman (R-West Jordan) filed House Bill 134 ( HB134 ) for the 2020 legislative session. The bill would expand raw milk sales to allow permit holders to sell raw milk cream and butter. The current law only allows the sale of pure raw milk even by those holding a permit. On Feb. 14, the House passed HB134 by a 60-0 vote .  Today, the Senate concurred with a vote of 23-0 . HB134 builds on an expansion of raw milk sales Gov. Gary Herbert  signed into law  in 2018. Under that new law, a milk producer can sell up to 120 gallons of raw milk per month to consumers without meeting stricter requirements under the current permitting program, providing certain conditions are met. Tenth Amendment Center: Idaho House Passes Bill to Expand “Constitutional Carry” Law

...from Tenth Amendment Center BOISE , Idaho (Feb. 28, 2020) – Yesterday, the Idaho House passed a bill to expand a current “constitutional carry” law, and let any U.S. citizen over 18 who can legally own a gun carry concealed in city limits without a permit. Currently, anyone over 18 can carry a concealed weapon without a permit in most places in Idaho, but only Idaho residents can do so within city limits. In 2015 lawmakers passed a bill allowing permitless concealed carry outside of city limits. In 2016, they got rid of the requirement for Idaho residents to need a permit to carry concealed within city limits. In 2019, the age for concealed carry in city limits was reduced from 21 to 18. If signed into law, House Bill 516 ( H516 ) would extend the broad concealed carry protections in the state to all U.S. citizens. Tenth Amendment Center: Maryland House Passes Bill to Ban Warrantless Stingray Spying; Hinder Federal Surveillance Program

(Feb. 28, 2020) – Yesterday, the Maryland House passed a bill that would ban the use of “stingrays” to track the location of phones without a warrant and prohibit police from sweeping up electronic communications. The proposed law would not only protect privacy in Maryland, but it would also hinder one aspect of the federal surveillance state. Del. David Moon (D), along with three fellow Democrats, introduced House Bill 499 ( HB499 ) on Jan. 24. The legislation would help block the use of cell-site simulators, known as “ stingrays .” These devices essentially spoof cell phone towers, tricking any device within range into connecting to the stingray instead of the tower. This allows law enforcement to sweep up communications content, as well as locate and track the person in possession of a specific phone or other electronic device. ...from Tenth Amendment Center Every so often I’m asked whether the Founders anticipated judicial review. In other words, whether the Founders expected the courts to void laws they found unconstitutional. The clear answer is “yes.” During the colonial era, each colony was governed by its charter, which was a kind of constitution for the colony. Colonial laws in violation of the charter were understood to be void. So also were laws that violated fundamental documents in the British Constitution, such as Magna Carta. During the ratification debates, both Federalists and Anti-Federalists assumed that the courts would have power to void unconstitutional laws. (Feb. 28, 2020) – Yesterday, a Missouri House committee unanimously passed a bill that would legalize retail sales of raw milk in the state and take a step toward nullifying a federal prohibition scheme in effect. Rep. Ann Kelley (R-Lamar) filed House Bill 1335 ( HB1335 ) in December. The legislation would legalize retail sales of raw milk or cream produced in Missouri at grocery stores, restaurants, soda fountains, or similar establishments, as long as the milk is clearly marked with a specified warning label. Currently, Missouri law only allows the sale and delivery of raw milk directly from farm to consumer. On Jan. 29, the House Agricultural Policy Committee approved HB1335 with a do-pass recommendation. Yesterday, the Rules Administrative Oversight Committee passed the bill by an 8-0 vote. Tenth Amendment Center: Kansas Senate Passes Bill to Expand Raw Milk Market; Foundation to Nullify Federal Prohibition Scheme

(Feb 28, 2020) – Yesterday, the Kansas Senate passed a bill that would help expand the market for raw milk in the state and take a step toward nullifying a federal prohibition scheme in effect. The Senate Agriculture and Natural Resources Committee introduced Senate Bill 308 ( SB308 ) on Jan. 23. Under current Kansas law, on-farm sales of raw milk and raw milk products are allowed but there are strict limits on the promotion of the product. SB308 would lift the restrictions on the promotion of raw milk and allow producers to advertise their products. SB308 would also expand the definition of raw milk to include the milk of all mammals. Under current law, farmers can only legally sell unpasteurized cow milk. The Senate passed the bill by a vote of 37-3 yesterday. ...from Tenth Amendment Center CHEYENNE , Wyo. (Feb. 27, 2020) – Today, the Wyoming House passed a bill that takes a step toward protecting the right to keep and bear arms from federal gun control. A coalition of 13 Republicans introduced House Bill 118 ( HB118 ) on Feb. 7. Titled the “Second Amendment Preservation Act,” the legislation would ban any “public servant” of the state and its political subdivisions, from enforcing any future federal “acts, laws, executive orders, administrative orders, court orders, rules, or regulations statute or ordinance” that infringe on the right to keep and bear arms and which is being litigated by the Wyoming attorney general on behalf of the citizens of Wyoming. In effect, should the federal government implement any new gun control measure, the law would trigger an immediate ban on the enforcement of those measures by the state of Wyoming. Tenth Amendment Center: Oklahoma Senate Passes Bill to Protect Gun Rights for Medical Marijuana Patients

(Feb. 27, 2020) – Yesterday, the Oklahoma Senate unanimously passed a bill prohibiting the state from denying a concealed carry firearms permit to medical marijuana users despite ongoing federal cannabis prohibition. Sen. Nathan Dahm (R-Broken Arrow), along with two Republican cosponsors in the House, introduced Senate Bill 959 ( SB959 ) on Feb. 4. Under the proposed law, a person in legal possession of a medical marijuana patient license could not be denied a concealed carry permit in the state solely on the basis of being a medical marijuana user. (Feb. 26, 2020) – A bill filed in the California Assembly would require police to follow the state Constitution and state law when participating in the FBI Joint Terrorism Task Force. Asm. Rob Bonta (D-Oakland) and Asm. David Chiu (D-San Francisco) introduced Assembly Bill 2598 ( AB2598 ), The California Safe Civil Rights Act , on Feb. 20. The bill would require a California law enforcement agency that participates in the Federal Bureau of Investigation’s (FBI) Joint Terrorism Task Force (JTTF) to do so only in a manner that is “fully consistent with the laws of the State of California, including the agency’s own policies, procedures, and orders.” Under current JTTF guidelines, FBI agents can open assessments and conduct intelligence gathering against anyone they choose without reasonable suspicion, which would put California law enforcement agents in violation of state law.
