Tenth Amendment Center: Delaware Bill Would Allow Parents to Opt Out Kids from Common Core Testing

(May 24, 2017) – A bill introduced in the Delaware House would allow certain students to opt out of Common Core Standards and testing, a small step toward nullifying nationalized education in the state. Introduced by Rep. John Kowalko (D-Newark) in January with 12 bipartisan co-sponsors, House Bill 60 ( HB60 ) would give parents the right to opt their children out of Common Core’s “Smarter Balanced” tests, and would require schools to give advanced notice to parents and students about these rights before tests are administered. Additionally, schools would be banned from punishing children who opt out of the assessments. The state would create a data system to track the opt-out decisions of individual students, and those numbers would be included in accountability reports “to provide context and impact on school and district ratings.” A similar measure was approved by the legislature in 2015, but was ultimately vetoed by former Gov. Tenth Amendment Center: North Carolina House Passes Bill to Encourage Use of Gold and Silver as Money

(May 23, 2017) – Today, the North Carolina House overwhelmingly passed a bill that would exempt the sale and purchase of gold and silver from state sales taxes, encouraging their everyday use and taking the first step toward breaking the Federal Reserve’s monopoly on money. Rep. Dana Bumgardner (R-Gastonia) and Rep. Jeff Collins (R-Rocky Mount) introduced House Bill 434 ( H434 ) in March. The legislation would exempt previous metals in various forms, including investment metal bullion, US Mint-produced gold and silver, investment coins and non-coin currency, from state sales tax. The House passed H434 on second reading by a 104-8 vote . It then gave final approval on the third reading by a voice vote. Tenth Amendment Center: To the Governor: Nevada Passes Bill to Legalize Commercial Hemp Production, Despite Federal Prohibition

(May 23, 2017) – Today, the Nevada Assembly gave final approval to a bill that would legalize commercial industrial hemp production in the state, despite a federal ban on the same. Passage into law would set the foundation to end federal prohibition in practice and effect within the state. A bipartisan coalition of 12 legislators introduced Senate Bill 396 ( SB396 ) in March. The legislation would authorize the cultivation of industrial hemp for commercial purposes and the production of agricultural hemp seed in Nevada. The bill expands current law that only allows an institution of higher education or the Nevada Department of Agriculture to cultivate industrial hemp for research purposes conducted under an agricultural pilot program or for other agricultural or academic research. Under the proposed law, the state would create separate licensing programs for growers, handlers and producers of hemp seed. The federal governme...

PHOENIX , Ariz. (May 23, 2017) – Yesterday, Arizona Gov. Doug Ducey signed a bill into law that eliminate states capital gains taxes on gold and silver specie, encouraging its use as currency. Once in effect, the new law will help undermine the Federal Reserve’s monopoly on money. Rep. Mark Finchem (R-Tucson) introduced House Bill 2014 ( HB2014 ) earlier this year. The legislation eliminates state capital gains taxes on income “derived from the exchange of one kind of legal tender for another kind of legal tender.” The bill defines legal tender as “a medium of exchange, including specie, that is authorized by the United States Constitution or Congress for the payment of debts, public charges, taxes and dues.” “Specie” means coins having pr...

Tenth Amendment Center: Massachusetts Bill Would Limit Warrantless Drone Surveillance; Hinder Federal Spy-State

...from Tenth Amendment Center BOSTON , Mass. (May 23, 2017) – A bill introduced in the Massachusetts Senate would limit the warrantless use of surveillance drones. The legislation would not only establish important privacy protections at the state level, it would also help thwart the federal surveillance state.Sen. Michael Moore (D-Shrewsbury), along with a bipartisan pair of cosponsors, introduced Senate Bill 1348 ( S1348 ) earlier this year. The legislation would prohibit the use of drones in criminal investigations without a warrant in most situations. The bill includes an exception to the warrant requirement in the event of an emergency “when there is reasonable cause to believe that a threat to the life or safety of a person is imminent.” If used in an emergency situation, law enforcement would be required to file an affidavit describing the grounds for the emergency access within 48 hours.
