Tenth Amendment Center: The Vote is in: Relying on Congress to Stop Federal Surveillance is Dangerous

Can states legally – and successfully – shut off water to a federal agency, like we’ve been proposing to do with NSA spying?

For years, lawyers at organizations like Electronic Frontier Foundation (EFF) and ACLU have told us in no uncertain terms that there’s no way they’d get on board with our effort to nullify NSA by turning off resources to the agency. They’ve told us it’s illegal. They’ve told us it’s impractical. They’ve told us it can’t be done.

But it has been done.

Instead, these groups have spent years focusing on congress and courts to stop federal spying. Today, the results are in. We’ve got a reauthorization – and expansion – of those powers going to the president’s desk for a signature.

The message is clear. Relying on federal courts and the federal congress to stop federal spying isn’t just foolish. It’s extremely dangerous.

We’ll keep pushing forward whether these groups join us or not. The path to liberty isn’t easy, but it’s clear.

Tenth Amendment Center: Rhode Island Bill Would Limit ALPR Use, Help Block National License Plate Tracking Program

...from Tenth Amendment Center PROVIDENCE , R.I. (Jan. 10, 2019) – A bill introduced in the Rhode Island House would prohibit “roadway surveillance,” including the use of automatic license plate readers (ALPRs) without a warrant in most situations. Passage into law would also place significant roadblocks in the way of a federal program using states to help track the location of millions of everyday people through pictures of their license plates. Tenth Amendment Center: Does Impeachment Require a Crime?

...from Tenth Amendment Center Popular commentary is suddenly awash with articles claiming that impeachment (and conviction and removal from office) do not require proof of a crime. Examples include Ezra Klein at Vox ( “High Crimes and Misdemeanors,” explained ), Elizabeth Drew in USA Today ( You don’t have to break a law to be impeached. Trump’s defenders need a better argument ) and Frank Bowman in The Atlantic ( The Common Misconception About ‘High Crimes and Misdemeanors’ ).  What’s notable from an originalist perspective is how originalist these articles are.
